1. Purpose of this policy

This Privacy Policy explains how STARTUP AIO S.R.L. ("the Operator", "we") collects, uses, stores and protects the personal data of users of the Gen2Video platform, in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Romanian law.

2. What data we collect

• Account data: email address, password (encrypted), or Google sign-in.
• Billing data: managed by our payment processor, Stripe; we do not store your full card number.
• Your content: text prompts, uploaded reference images, and the resulting generations (images, video).
• Usage data: generation history, credits consumed, AI models used.
• Technical data: IP address, device and browser type, at the standard level collected by our hosting infrastructure.

3. How we use your data

• To provide the AI generation service and manage your account;
• To process payments and billing;
• To automatically refine prompts sent to AI models, for better results;
• For technical support and communications related to your account or the service;
• For security and abuse prevention.

4. Legal basis for processing

• Performance of a contract (GDPR art. 6(1)(b)) — to provide the requested service;
• Legal obligation (GDPR art. 6(1)(c)) — for invoicing and accounting records;
• Legitimate interest (GDPR art. 6(1)(f)) — for security and service improvement;
• Consent (GDPR art. 6(1)(a)) — where explicitly required, for example for non-essential cookies.

5. Third-party processors acting on our behalf

To provide the Service, we share data with the following processors, each with its own privacy policy:

• Supabase — database, authentication, and storage of generated content (hosted in the EU, Frankfurt);
• Stripe — payment processing and billing;
• fal.ai and the AI models hosted through it — the actual processing of image and video generations, based on the prompt and reference files submitted;
• Anthropic (Claude API) — automatic prompt refinement and cultural adaptation for supported languages;
• Vercel — hosting of the web application.

Some of these providers (fal.ai, Anthropic, Stripe, Vercel) may process data outside the European Economic Area, primarily in the United States. In these cases, we ensure the transfer relies on adequate safeguards, such as the Standard Contractual Clauses approved by the European Commission.

6. Data retention period

Generated content remains available in your account for as long as your subscription is active. After a subscription is cancelled, content remains downloadable for 30 days, then it is automatically and permanently deleted. Contractual and billing data is kept for 10 years, in accordance with accounting legislation. Account data is kept until account deletion, at your request.

7. Your rights

Under GDPR, you have the right to:

• access the data we hold about you;
• request correction of inaccurate data;
• request deletion of your account and associated data ("the right to be forgotten");
• request restriction of, or object to, processing;
• request data portability;
• withdraw any consent given, at any time;
• lodge a complaint with the Romanian National Supervisory Authority for Personal Data Processing (dataprotection.ro).

8. Data security

We apply technical and organizational measures to protect your data: secure connections (HTTPS), access control, per-user data isolation at the database level (row-level security), and password encryption. In the event of a security incident that could affect personal data, we will notify the competent authorities and, where applicable, affected individuals, in accordance with GDPR.

10. Changes to this policy

We reserve the right to periodically update this policy. The most recent version will be available on the site, with the update date shown. Continued use of the Platform after changes are published constitutes acceptance of the new terms.
